LEGAL NOTICE - Airworthiness - Liability - warranty

Viking Aircraft Engines, as manufacturer, warrants every Viking aircraft engine, sold and delivered by Viking or an authorized Viking distributor/reseller, to be free from defects in material and workmanship for a period of 12 months or 100 hours, whichever happens first. Warranty starts on the day of shipment. Extended warranty is available through Viking if desired.

Replacement of any engine, accessory or part under the warranties will not create a new warranty period or extend the period of coverage. But any engine, part or accessory so repaired or replaced will be warranted for the remainder of the original warranty period applicable to the engine, accessory or part repaired or replaced.

Warranty claim

Written notice of any warranty claim must be submitted to Viking within fifteen (15) days of a suspected defect in material or workmanship and the engine, accessory or part must be made available for Vikings inspection within thirty (30) days after the claim has been made.

To evaluate a claim, following items must also be made available:

Invoice delivered to the customer as proof of date of purchase/delivery.
Engine logbook showing engine time and all maintenance performed.
Signed and dated inspection/maintenance sheets.

Viking reserves the right not to accept any claim not submitted in accordance with these requirements

TERMS AND CONDITIONS

The LIMITED WARRANTIES cover all parts and labor on engines and accessories subjected to normal use and operated and maintained in strict accordance with the corresponding Operating and Maintenance Manuals. All maintenance must be immediately noted, dated and signed in engine logbook when maintenance is performed or the warranties are VOID. Warranty service may be accomplished ONLY AFTER PRIOR WRITTEN APPROVAL from Viking. Viking retains the right to repair and/or replace any parts or accessories required for warranty service. All parts replaced under warranty become the property of Viking. The warranties are VOID on any engine or accessory, disassembled, opened, repaired or altered without the prior written approval of Viking. The warranties are also VOID on any engine or accessory which has been operated contrary to corresponding Installation, Operating and Maintenance procedures or which in Viking’s sole opinion has been subjected to misuse, neglect, improper installation, corrosion, foreign material ingestion, accident, the use of improper oil, fuel or non-genuine Viking replacement parts. The warranties do not include reimbursement for normal maintenance expenses or for incidental expenses such as but not limited to, mounting and dismounting of the engine from the aircraft, loss of use, transportation, towing, communication costs, taxis, hotels, food or any other incidental or consequential damage.

VIKING’S OBLIGATIONS AND PURCHASER'S REMEDIES UNDER VIKING’S EXTENDED WARRANTIES ARE LIMITED TO VIKING’S CHOICE OF REFUND, REPAIR OR REPLACEMENT ON AN EXCHANGE BASIS AND EXCLUDE LIABILITY FOR INCIDENTAL, SPECIAL, CONSEQUENTIAL OR ANY OTHER DAMAGES, INCLUDING WITHOUT LIMITATION, ANY LIABILITY OF CUSTOMER TO A THIRD PARTY OR FOR ECONOMIC LOSS, REPLACEMENT COST, COST OF CAPITAL, LOST REVENUE, LOST PROFITS, OR LOSS OF USE OF OR DAMAGE TO AN AIRCRAFT, ENGINE, COMPONENT OR OTHER PROPERTY AND IN NO EVENT WILL VIKING’S LIABILITY EXCEED THE ORIGINAL COST OF THE ENGINE OR ACCESSORY.

These LIMITED WARRANTIES are the only warranties offered by Viking.

These LIMITED WARRANTIES are the only warranties offered by Viking. No agreement varying these warranties or Viking’s obligations under them will be binding on Viking unless made in writing by a duly authorized representative of Viking and accepted in writing by Viking.

Viking will not process or honor warranty claims on delinquent accounts.

Please use all guidelines and general safety measures for the installation of your engine. Viking is not responsible for individual engine installations nor workmanship of an individual.

The use of non-genuine/unauthorized parts and/or unapproved modifications fitted to any Viking Aircraft Engines constitutes a modification and/or alteration and as such all warranties express or implied, to the extent permitted by law, are voided. A product should be maintained in accordance with the requirements of the manufacturer, meets approved type design and has not been modified unless approved by the manufacturer.
Viking Aircraft Engines does not warrant or accept liability for any damage or malfunction caused by non-genuine/unauthorized parts and/or unapproved modifications fitted to any Viking Aircraft Engine (and any subsequent damage, including damage or malfunctions to associated parts or systems).
Viking Aircraft Engines does not warrant or accept liability for any damage or malfunction caused by failure to comply with Service Bulletins and/or Service Letters, lack of maintenance, including, but not limited to, the failure to follow recommended maintenance procedures, types of lubrications and/or fuels and use instructions as set forth in the Engine Maintenance Manuals, Aircraft Technical Manuals and Propeller Manuals.
The installation of non-genuine/unauthorized parts and/or unapproved modifications to any Viking Aircraft Engine constitutes a complete and total waiver to the extent permitted by law of any and all rights the operator may have had to hold Viking Aircraft Engines responsible or liable for the malfunction or failure of such a non-genuine/unauthorized part and or unapproved modification.
To the extent permitted by law, the owner, operator, overhaul facility and/or maintainer responsible for installation of non-genuine/unauthorized parts and/or unapproved modifications to any Viking Aircraft Engine shall bear the responsibility and liability for any damages of whatever nature, injury or death arising from any malfunction or failure of such non genuine/unauthorized and/or unapproved modification.
A non-genuine/unauthorized part and/or unapproved modification is classed as any product that is a parallel, imitation, salvaged, counterfeit and/or aftermarket item that has not been manufactured and/or sourced directly from Viking Aircraft Engines or can be traced back as supplied to an authorized dealer direct from Viking Aircraft Engines.
The use of a different ECU or altered ECU is strictly prohibited as it changes the operation and safety of the engine.
The use of a cowling design not from Viking, is not under warranty. Adequate cooling and flow is fully tested with our setup, any type of overheating due to the use of own/another design could cause overheating and long lasting damage.
With the use of any Lithium battery, due to their instability and unpredictability, especially those with a Battery Management System - warranty will not be valid.
We do not warranty any engine that has used 100LL fuel due to no way of confirming the use of a lead scavenger (like Decalin)
We highly discourage and do not support the use of any other style throttle cable other than the push/pull style offered.
